Atlantic Recovery Solutions on Your Credit Report? Fight Back and Win

Atlantic Recovery Solutions, LLC (ARS), is a debt collection company based out of New York State. Similar to many collection agencies, ARS is responsible for recovering debts for their clients. Their most common clients include banks, credit card companies, or other financial institutions.

ARS has been in business for many years and has been accredited with the Better Business Bureau (BBB) since 2015. However, like many collection agencies, they are not immune to complaints about their collections practices. According to BBB, consumers have filed several complaints about ARS’ debt collection methods – including harassment and contact at inappropriate hours.

Some people have also reported that ARS has attempted to collect debts that they did not owe. Complaints like this are common in the debt collection industry, which is why it's super important for consumers to understand their rights and verify the debt before going through with any payments or arranging a payment plan.

ARS currently has an A- rating with BBB, which seems high considering the high number of complaints filed against them. The company does have a 100% response rate and resolves all complaints, which also allows them to keep their high rating and accreditation with BBB.

Keep in mind that even though a company has been on the receiving end of complaints does not automatically mean they are operating outside of the law or engaging in fraudulent activities. Every situation is unique, and consumers still have the right to file complaints even if no law was broken.

Legit or Scam?

To be fully transparent – this is not a scam, ARS is a legitimate debt collection agency. However, like many other collection agencies, they are not immune to complaints regarding their collections practices. We highly recommend being cautious and taking the time to understand your rights as you proceed with your situation involving ARS.

Be sure to take note of every interaction you have with the company and keep records of every time you receive a call from them.

Who Does ARS Collect For?

Atlantic Recovery Solutions collects for a variety of clients, including banks, credit card companies, and other financial institutions. ARS is typically hired to collect delinquent debts that have been charged off by their clients, which implies that these debts are no longer considered collectible by the original creditor, and have been turned over to a collections agency for attempted recovery.

ARS may also collect debts for a number of other clients, such as healthcare providers, telecommunications companies, and retail merchants. Be sure to keep in mind that while ARS may be the company contacting consumers regarding these debts, that does not mean that they own the debt – they do not have the ability to change the original terms of the agreement.

Why Do They Keep Calling Me?

If you have been receiving frequent calls from ARS, it's important to understand the collections practices of the company and your rights in this situation. Under the Fair Debt Collection Practices Act (FDCPA), debt collectors are not permitted to harass, threaten, or use abusive language when trying to collect a debt – they can only call you between the hours of 8:00 a.m. and 9:00 p.m.

Also if you request in writing that they stop calling, they must adhere to your request.

In some cases, ARS may be calling you about a debt that has been paid off, settled, or that is already beyond the statute of limitations. It's important to first verify the debt – if it is beyond the statute of limitations, DO NOT make any payment as this will activate the debt and make it collectible again.

You can ask ARS to verify the debt, including the amount and the name of the original creditor. If ARS is unable to provide proof of the debt, they are required to stop collection efforts. If the debt is legitimate, there are many ways in which you can proceed – we will cover these in the next section.

If you believe that ARS is harassing you or potentially infringing on your rights protected under the FDCPA, it's vital that you document each instance and consider seeking professional guidance.

You have protected rights as a consumer, and collection agencies must be in accordance with laws that regulate their industry. Unfortunately many such companies tend to stray from these laws in order to pressure consumers and successfully recover debt for their clients – this is why it’s essential for you to understand your rights.

How Should I Navigate the Situation with ARS?

If the company provides verification and the debt is legitimate, it may be best for you to make arrangements to pay it off. You can negotiate a plan to pay off your debt with ARS – you have many options, including a lump sum payment, a payment plan, or if you believe the debt has already been paid or that there is a mistake, you do have the right to dispute it.

Regardless, if the company is calling outside of appropriate hours, harassing you, calling incessantly, or using aggressive collection tactics, consider contacting a professional to help navigate the situation.

Dealing with debt collection can be stressful and overwhelming, especially if you're not sure if you owe the debt or if the collection agency is legitimate.
